These Terms of Service ("Terms") govern your access to and use of the Fit Foundations Academy website, programs, coaching services, supplements, digital products, the FFA coaching app, and any related content, community, communications, or tools we provide (collectively, the "Services"). By visiting our website, purchasing any product, or using any part of the Services, you agree to these Terms.

If you do not agree, do not use the Services.

2) Eligibility

You must be at least 18 years old (or the age of majority in your location) to purchase or use our Services. By using the Services, you confirm you meet this requirement.

3) What We Provide

Fit Foundations Academy provides fitness coaching, education, supplements, and digital products. Depending on what you purchase, this may include:

  • Online coaching programs (including fixed-term contracts such as 6-month coaching)
  • Customized training programming and nutrition guidance
  • Habit and accountability coaching, check-ins, and support
  • Access to the FFA coaching app (powered by Trainerize)
  • Digital products (macro calculator, downloadable guides, training blocks, challenges)
  • Supplements and physical goods
  • Free tools, lead magnets, and educational content
  • Affiliate product recommendations (including Amazon Associates links)

Specific deliverables, frequency of check-ins, access length, and included features are defined on the offer page and at checkout for your specific purchase.

4) Important Health Disclaimer (Not Medical Advice)

We are not doctors or medical providers, and the Services are not medical care or medical advice.

You understand and agree:

  • You should consult a qualified healthcare professional before starting any fitness, nutrition, or supplement program, especially if you have any medical conditions, injuries, allergies, are pregnant or nursing, or take prescription medications.
  • You are responsible for your own health decisions and outcomes.
  • Results vary by individual and are not guaranteed.
  • Supplements sold or recommended by FFA are not intended to diagnose, treat, cure, or prevent any disease. Statements about supplements have not been evaluated by the FDA.

5) Assumption of Risk

Fitness training, dietary changes, and supplementation involve inherent risks, including injury, illness, allergic reaction, and other adverse outcomes. By participating, you voluntarily assume all known and unknown risks related to your participation, and you release Fit Foundations Academy from liability for any injuries, illnesses, or losses resulting from your use of the Services, to the maximum extent permitted by law.

6) Purchases, Pricing, and Payments

A) Pricing

All prices are shown at checkout or on the sales page and may change at any time. Changes do not affect purchases already completed.

B) Payment Processing

Payments are processed through third-party processors including Stripe, Shop Pay, PayPal, Apple Pay, Google Pay, Amazon Pay, and similar providers. We do not store full payment card numbers.

C) Financing and Pay-Over-Time

If you choose a financing or pay-over-time option (Klarna, Affirm, Shop Pay Installments, or similar), that financing agreement is between you and the financing provider. You are responsible for complying with their terms and making all required payments.

Choosing financing does not change our no-refund policy (Section 8) and does not release you from your full purchase obligation.

D) Failed Payments and Charge Authorization

If you purchase a plan that bills in installments or recurring charges, you authorize us and our payment processors to charge your saved payment method according to the schedule shown at checkout.

If a payment fails:

  • we may pause or limit access to Services (including app access) until the account is brought current,
  • you remain responsible for the full balance owed,
  • collection fees and interest may apply where permitted by law and disclosed at checkout.

7) Program Term, Access, and Renewal

A) Fixed-Term Coaching Programs (Including 6-Month Contracts)

Some programs are sold as fixed-term packages, including our 6-month coaching program. Your access and support are provided for the term described at checkout or in your agreement.

By enrolling in a fixed-term program, you understand and agree that:

  • you are committing to the full term and the full payment obligation,
  • if you stop participating, fail to complete check-ins, or stop using the app, you remain responsible for the full balance,
  • access may be paused in limited circumstances (see Refund Policy), but a pause is not a cancellation and does not reduce your payment obligation,
  • ending your participation early does not entitle you to a refund.

B) Subscriptions and Auto-Renewing Plans

If we offer a subscription plan, it will be clearly disclosed at checkout as auto-renewing, including billing frequency, amount, and how to cancel.

You can cancel future renewals by following the cancellation instructions at checkout or by emailing fitfoundationsacademy2025@gmail.com. Cancellation stops future billing after the effective date; it does not refund prior charges.

C) App and Content Access

Access to the FFA coaching app, digital content, and program materials is contingent on your account being in good standing. We may revoke access for non-payment, chargeback filings, or violations of these Terms.

8) Refund Policy — All Sales Final for Coaching and Digital Products

No refunds on coaching programs or digital products.

Due to the nature of coaching services, digital delivery, and immediate access to program materials, all purchases of coaching programs, digital products, downloadable guides, and challenges are final and non-refundable. This includes:

  • paid-in-full purchases,
  • deposits,
  • installments,
  • financed purchases (Klarna, Affirm, Shop Pay Installments, and others),
  • recurring or subscription payments already processed.

Supplements and physical products are governed by our separate Refund Policy, which allows limited returns within 30 days under specific conditions.

9) Client Responsibilities

To get the best outcome, you agree to:

  • provide accurate intake information,
  • communicate respectfully and honestly,
  • follow the plan and guidance to the best of your ability,
  • ask questions when unclear,
  • use the Services safely and within your physical limits,
  • disclose any medical conditions, injuries, or medications that could affect your participation.

You are responsible for your own compliance, consistency, and results.

10) Coaching Communication Standards

We may communicate through email, in-app messaging, SMS, or social platforms (including Facebook Messenger and Instagram DMs). Response times vary. Unless explicitly stated in your offer, we do not guarantee real-time or 24/7 availability. Coaching communication is for the purpose of fitness coaching and program delivery only.

11) Acceptable Use

You agree not to:

  • share, resell, screenshot for redistribution, or distribute our programs, PDFs, workouts, videos, app content, or other materials,
  • harass, threaten, or abuse our staff, coaches, or community members,
  • attempt to bypass paywalls or access restrictions,
  • use the Services for unlawful purposes,
  • impersonate another user or provide false information,
  • post defamatory or misleading reviews or social media content about FFA.

We may suspend or terminate access for violations without refund.

12) Intellectual Property

All content, branding, videos, training materials, written plans, app content, and program resources are owned by Fit Foundations Academy or licensed to us and protected by intellectual property laws.

You receive a limited, personal, non-transferable, revocable license to use purchased materials for your own personal, non-commercial use only. You may not copy, sell, or distribute any FFA content without our written permission.

13) Testimonials, Progress Photos, and Marketing Consent

When you submit progress photos, before-and-after images, video check-ins, testimonials, reviews, or similar content to FFA — through our app, intake forms, email, SMS, social media DMs, or any other channel — you grant FFA an irrevocable, royalty-free, worldwide, perpetual license to use, reproduce, edit, crop, adapt, publish, display, and distribute that content for any business or marketing purpose, including website content, social media posts and ads, email and SMS marketing, paid advertising, testimonials, case studies, before-and-after graphics, live broadcasts, and printed materials.

This includes use of your first name, initials, location, age, and stats (such as weight or inches lost) alongside your images.

You may opt out of future marketing use by emailing fitfoundationsacademy2025@gmail.com with the subject line "Photo Opt-Out." Opt-outs apply going forward only. Content already published, printed, or distributed may continue to circulate, and we are not obligated to recall or replace it.

14) Supplements and Physical Goods

Supplements and physical products are sold subject to our Refund Policy and any product-specific terms shown at checkout. You agree:

  • to read all product labels, ingredients, and warnings before use,
  • to consult a healthcare provider if you have allergies, medical conditions, or take medications,
  • that supplement statements have not been evaluated by the FDA,
  • that supplements are not intended to diagnose, treat, cure, or prevent any disease,
  • that we are not the manufacturer of all supplements sold and rely on manufacturer representations.

15) Affiliate Links and Recommendations

FFA participates in affiliate programs including the Amazon Associates program. When you click an affiliate link on our website, social media, emails, or messages and make a purchase, we may earn a commission at no additional cost to you. Affiliate purchases are governed by the third party's terms and policies, not ours.

16) Third-Party Platforms

We use third-party tools including Shopify, Trainerize, Stripe, Klarna, and others. Your use of those tools is subject to their separate terms and privacy policies. We are not responsible for third-party outages, delays, billing issues, or platform issues beyond our control.

17) Chargebacks and Payment Disputes

If you have a billing concern, you agree to contact us at fitfoundationsacademy2025@gmail.com before filing a chargeback or payment dispute. Filing a chargeback without first attempting to resolve the issue with us may result in:

  • immediate suspension of all Services and app access,
  • collection of the disputed amount and any associated fees,
  • termination of your account.

Chargebacks filed in violation of these Terms may be contested with documentation of services rendered, app usage, communications, and your agreement to these Terms.

18) Disclaimer of Warranties

The Services are provided "as is" and "as available." We make no warranties, express or implied, that the Services will be uninterrupted, error-free, secure, or that any particular results will be achieved. To the maximum extent permitted by law, we disclaim all warranties including warranties of merchantability, fitness for a particular purpose, and non-infringement.

19) Limitation of Liability

To the maximum extent permitted by law, Fit Foundations Academy and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Services.

Our total liability for any claim related to the Services will not exceed the amount you paid to us for the Services in the three (3) months preceding the event giving rise to the claim.

20) Indemnification

You agree to indemnify, defend, and hold harmless Fit Foundations Academy, its owners, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • your misuse of the Services,
  • your violation of these Terms,
  • your violation of any law or third-party rights,
  • any injury or health outcome resulting from your participation.

21) Disputes, Arbitration, and Governing Law

Governing Law: These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Informal Resolution: Before filing any claim, you agree to contact us at fitfoundationsacademy2025@gmail.com and attempt to resolve the issue informally for at least 30 days.

Binding Arbitration: Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding arbitration in Las Vegas, Nevada, under the rules of the American Arbitration Association, and not in court, except that either party may bring a qualifying claim in small claims court.

Class Action Waiver: You and Fit Foundations Academy waive any right to a trial by jury and waive any right to participate in a class action, class arbitration, or representative action. Claims must be brought individually.

22) Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms, non-payment, chargeback filings, or harmful conduct toward our staff or community. Termination does not relieve you of any outstanding payment obligations and does not entitle you to a refund.

23) Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

24) Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Fit Foundations Academy regarding the Services and supersede all prior agreements.

25) Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date will reflect changes. Material changes will be posted on this page. Continued use of the Services after changes means you accept the updated Terms.
