This Privacy Policy explains how Fit Foundations Academy ("Fit Foundations Academy," "FFA," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit our website, purchase a product or program, use our coaching app, interact with us on social media or messaging platforms, or otherwise engage with our services (collectively, the "Services").

This policy covers all FFA offerings, including:

  • Online coaching programs (including 6-month coaching contracts)
  • Supplements and physical products
  • Digital products (macro calculator, downloadable guides, training blocks)
  • The FFA coaching app (powered by Trainerize)
  • Free tools, lead magnets, and email/SMS communications
  • Affiliate product recommendations (including Amazon Associates links)

1) What We Collect

We collect information in three ways: (a) information you provide, (b) information collected automatically, and (c) information from third parties.

A. Information you provide

Depending on how you use our Services, you may provide:

  • Identifiers and contact details: name, email, phone number, billing and shipping address.
  • Account and intake information: goals, preferences, training and nutrition history, lifestyle and habit details submitted through coaching applications, intake forms, and check-ins.
  • Fitness and body data (may be sensitive): weight, measurements, progress photos, workout performance, nutrition logs, sleep, stress, hormones, and similar data you choose to share.
  • Payment details: we do not store full card numbers. Payments are processed by third-party processors (see Section 4).
  • Communications: messages, emails, DMs, support requests, comments, and forms you submit, including content shared through Facebook Messenger, Instagram DMs, SMS, and email.
  • Order details: for supplement and physical product orders, including items purchased and shipping information.

B. Information collected automatically

When you visit our website or use our Services online, we may automatically collect:

  • Device and browser info: IP address, device identifiers, browser type, operating system, language, time zone.
  • Usage data: pages viewed, time spent, clicks, referring and exit pages, and interactions.
  • Cookie and similar tech data: cookies, pixels, tags, and similar tracking technologies from us and our partners (including Shopify, Meta/Facebook, Google, and TikTok).

C. Information from third parties

We may receive information from service providers and platforms you use to interact with us, including:

  • Payment processors (Stripe, Shop Pay, PayPal, Apple Pay, Google Pay, Amazon Pay)
  • Buy now, pay later and financing providers (Klarna, Affirm, Shop Pay Installments, where offered)
  • Coaching app and program delivery (Trainerize)
  • Email and SMS providers
  • Analytics and advertising partners (Meta/Facebook, Google, TikTok)
  • Social platforms (Facebook, Instagram, TikTok) when you interact with our pages or DMs
  • Amazon (in connection with our Amazon Associates affiliate program)

2) Sensitive Information (Fitness and Health-Related Data)

Some information you share with us may be considered sensitive in certain jurisdictions, including fitness measurements, progress photos, nutrition logs, body composition data, and related information.

We use this information only to:

  • deliver coaching services,
  • personalize your program,
  • track progress you choose to track,
  • provide support and accountability,
  • and, where you have consented, for marketing as described in Section 3.

Fit Foundations Academy is not a medical provider and is not a "covered entity" under HIPAA. Do not submit medical records, diagnoses, or protected health information unless we explicitly request it. Coaching is not medical advice and is not a substitute for care from a licensed healthcare provider.

3) Consent to Use Progress Photos, Before-and-After Images, Testimonials, and Results

When you submit progress photos, before-and-after images, transformation pictures, video check-ins, testimonials, reviews, written feedback, or similar content to Fit Foundations Academy — whether through our coaching app, intake forms, email, SMS, social media DMs, or any other channel — you grant FFA an irrevocable, royalty-free, worldwide, perpetual license to use, reproduce, edit, crop, adapt, publish, display, and distribute that content for any business or marketing purpose, including:

  • website content and landing pages,
  • social media posts and ads (Facebook, Instagram, TikTok, YouTube, and others),
  • email and SMS marketing,
  • paid advertising campaigns,
  • testimonials and case studies,
  • before-and-after comparison graphics,
  • live broadcasts, podcasts, and on-camera Q&A content,
  • printed materials and presentations.

What this means

  • We may use your photos, name, first name only, initials, location (such as city or state), age, and stats (such as weight lost, inches lost, time frame) alongside your images.
  • We may crop, resize, color-correct, add text overlays, brand watermarks, or otherwise edit content for presentation.
  • We may continue to use previously published content even after you stop working with FFA.

What we do not do

  • We do not sell your photos or personal information to third parties.
  • We do not share medical records or HIPAA-protected health information.
  • We do not publish content we know to be misleading about your results.

Your right to opt out

You can tell us at any time that you do not want your photos or testimonials used for marketing. To opt out, email fitfoundationsacademy2025@gmail.com with the subject line "Photo Opt-Out" and include your name and the email used on your account.

Opting out applies going forward. Content that has already been published, printed, embedded in ads, or distributed before your opt-out request may continue to circulate, and we are not obligated to recall, delete, or replace content already in use.

If you are under 18

You may not submit photos or testimonials without a parent or legal guardian's written consent. Our Services are intended for adults — see Section 11.

4) How We Use Personal Information

We use personal information to:

  • Provide and operate Services: coaching delivery, app access, program management, supplement order fulfillment, and customer communications.
  • Process transactions: payments, subscription billing, financing arrangements, confirmations, receipts, and fraud prevention.
  • Support and respond: customer service and troubleshooting.
  • Improve our Services: analytics, testing, content development, and performance optimization.
  • Marketing and advertising: sending updates, offers, content, showing ads where allowed by law, and using progress photos, testimonials, and results content as described in Section 3.
  • Affiliate and referral programs: tracking referrals through affiliate links (including Amazon Associates) where applicable.
  • Security and legal purposes: preventing fraud, enforcing our terms, and complying with legal requests.

5) How We Share Personal Information

We share personal information only as needed to run our business and provide Services.

Service providers and processors

  • Payments and financing: Stripe, Shop Pay, PayPal, Klarna, Apple Pay, Google Pay, Amazon Pay, and similar.
  • Coaching app and program delivery: Trainerize (which powers our white-labeled FFA app).
  • E-commerce and hosting: Shopify (our store platform).
  • Shipping and fulfillment: carriers and fulfillment partners for supplement and physical product orders.
  • Email, SMS, and messaging tools.
  • Analytics and customer support tools.

These vendors are permitted to use personal information only to perform services for us.

Advertising and analytics partners

We may share certain identifiers, cookies, and online activity data with platforms including Meta/Facebook, Google, and TikTok to measure performance, run retargeting, and show ads. In some jurisdictions this may be considered "sharing" or "selling" for targeted advertising purposes.

Affiliate partners

When you click an affiliate link (including Amazon Associates links) on our website, social media, or in our messages, the destination site may collect information about your visit and purchase. We may earn a commission from qualifying purchases. Those purchases are governed by the third party's own privacy policy.

Legal and business transfers

We may share information:

  • to comply with law or legal process,
  • to protect rights and safety,
  • during a business transaction (e.g., restructuring, sale, or merger).

6) Cookies, Analytics, and Targeted Advertising

We and our partners use cookies and similar technologies for:

7) Subscription Billing, Recurring Payments, and Financing

Some of our programs (including 6-month coaching contracts) involve recurring or installment payments processed through Stripe, Klarna, Shop Pay, or similar providers.

By enrolling, you authorize us and our payment processor to charge the payment method on file for the agreed schedule. Cancellation, pause, and refund terms are governed by our Terms of Service and Refund Policy — please review them carefully before purchasing.

8) Your Privacy Choices and Rights

Your rights depend on your location. We honor valid requests consistent with applicable law.

A. Marketing communications

  • Email: unsubscribe using the link in our emails.
  • SMS: reply STOP to opt out.
  • Photos and testimonials: see Section 3.

B. U.S. state privacy rights (including California)

Depending on your state, you may have rights to:

  • access or confirm processing,
  • receive a copy of your data,
  • delete your data,
  • correct inaccuracies,
  • opt out of targeted advertising,
  • opt out of certain "sales" or "sharing" of personal information,
  • limit the use of sensitive personal information.

9) Data Retention

We keep personal information only as long as necessary for:

  • delivering Services,

  • resolving disputes,
  • enforcing agreements.

Retention periods vary by data type. Some records (such as transaction history and previously published marketing materials) may need to be retained even after a deletion request.

11) Children's Privacy

Our Services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has submitted information to us, contact us and we will delete it.

13) Refunds, Cancellations, and Program Terms

Refunds, cancellations, pauses, and program terms are not governed by this Privacy Policy. See our Refund Policy and Terms of Service.

We may update this Privacy Policy from time to time. The "Last Updated" date will reflect changes. Material changes will be posted on this page.
